1. Agreement to Terms

By accessing or using the services provided by It's Handled (operated by SDG Services Pty Ltd, ABN 30 664 897 429), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

"Services" refers to our digital estate management services, including account discovery, account closure requests, The Vault pre-registration service, and our website.

2. Eligibility

To use our Aftercare service, you must:

  • Be at least 18 years of age
  • Have legal authority to manage the deceased person's digital estate (as executor, administrator, or next of kin)
  • Provide accurate and truthful information
  • Have a valid payment method

To use The Vault service, you must:

  • Be at least 18 years of age
  • Be registering your own accounts (not someone else's without their consent)
  • Have a valid payment method

3. Our Services

3.1 Aftercare Service

Our Aftercare service includes:

  • Discovery of online accounts associated with the deceased's email addresses and phone numbers
  • Submission of closure or memorialization requests to identified platforms
  • Submission of subscription cancellation requests
  • Follow-up communications with platforms
  • A closure report upon completion

3.2 The Vault Service

The Vault service includes:

  • Secure storage of your account information
  • Executor nomination and notification
  • Ability to update your information at any time
  • Full Aftercare service when activated by your executor

3.3 What We Don't Do

  • We do not access, log into, or control any accounts
  • We do not guarantee that all platforms will comply with closure requests
  • We do not provide legal advice
  • We do not handle physical assets or financial accounts requiring probate
  • We do not recover passwords or bypass security measures

4. Your Responsibilities

By using our services, you represent and warrant that:

  • All information you provide is accurate and complete
  • You have legal authority to act on behalf of the deceased's estate
  • You will provide requested documentation (death certificates, proof of relationship) when required
  • You will not use our services for any unlawful purpose
  • You will not attempt to close accounts of living persons without their consent

5. Authorization

When you submit an Aftercare case, you authorize us to act on your behalf to:

  • Discover online accounts held by the deceased
  • Contact platforms and service providers as your representative
  • Submit closure, deletion, or memorialization requests
  • Request refunds on your behalf where applicable
  • Receive correspondence regarding these accounts

This authorization is recorded electronically with your IP address and timestamp. You may revoke this authorization at any time by contacting us, though fees for work already completed are non-refundable.

6. Fees and Payment

6.1 Pricing

  • Aftercare: $249 AUD (one-time payment)
  • The Vault Yearly: $99 AUD per year
  • The Vault Lifetime: $299 AUD (one-time payment)

All prices include GST where applicable.

6.2 Payment Processing

Payments are processed securely by Stripe. By providing payment information, you authorize us to charge the applicable fees.

6.3 Refunds

  • If we are unable to discover any accounts (rare), we will refund your payment in full
  • Once we have begun work on account closures, fees are non-refundable
  • The Vault yearly subscriptions may be cancelled at any time; no refunds for partial periods

7. Service Limitations

You acknowledge and agree that:

  • We cannot guarantee that all accounts will be successfully closed (some platforms may refuse or have lengthy processes)
  • Timeframes are estimates only; some platforms take longer than others
  • Account discovery depends on the information you provide; we may not find accounts registered under different details
  • We rely on platforms' published processes for deceased users, which may change
  • Some platforms may require you to provide additional documentation directly

8. Intellectual Property

All content on our website, including text, graphics, logos, and software, is the property of SDG Services Pty Ltd and is protected by Australian and international copyright laws. You may not reproduce, distribute, or create derivative works without our written permission.

9. Limitation of Liability

To the maximum extent permitted by Australian Consumer Law:

  • We are not liable for any indirect, incidental, or consequential damages
  • Our total liability is limited to the amount you paid for the service
  • We are not liable for actions or inactions of third-party platforms
  • We are not liable for delays caused by platforms' processing times

Nothing in these terms limits your rights under the Australian Consumer Law, including consumer guarantees that cannot be excluded.

10. Indemnification

You agree to indemnify and hold harmless SDG Services Pty Ltd, its directors, employees, and agents from any claims, damages, or expenses arising from:

  • Your breach of these Terms
  • Your misrepresentation of your authority to act on behalf of an estate
  • Inaccurate information you provide
  • Your violation of any law or rights of a third party

11. Privacy

Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

12. Termination

We may suspend or terminate your access to our services if you breach these Terms or if we reasonably believe you are misusing our services. Upon termination:

  • Your right to use the services ceases immediately
  • We will complete any work already in progress
  • Data retention will follow our Privacy Policy

13. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes will be resolved in the courts of New South Wales, and you consent to the exclusive jurisdiction of those courts.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of our services after changes constitutes acceptance of the new Terms.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
